Motion.ai is operated by Arkn LLC ("we," "our," "us"). By downloading, accessing, or using Motion.ai (the "App"), you agree to be bound by these Terms of Service (the "Terms"). If you do not agree to these Terms, do not use the App.

02Description of service

Motion.ai is a fitness tracking application that helps you:

• Log physical activities.
• Track calorie burn.
• Set and monitor fitness goals.
• Use AI-powered activity classification.

03Account registration

Creating an account

• You must provide accurate and complete information.
• You must be at least 13 years old to use the App.
• You are responsible for maintaining the security of your account.
• You are responsible for all activities under your account.

Account security

• Notify us immediately of any unauthorized use.
• We are not liable for losses caused by unauthorized use of your account.

04AI-powered features

Activity classification

Motion.ai uses artificial intelligence (Mistral AI) to help classify your activities.

Important: AI classifications may occasionally be incorrect. You should always review and confirm AI-generated results. AI-suggested calorie calculations are estimates, not medical advice. We are not responsible for decisions you make based on AI classifications.

Your responsibility

• Review all AI-generated activity classifications before saving.
• Manually correct any inaccurate classifications.
• Do not rely solely on AI for medical or health decisions.

05User content

Content you provide

• You retain ownership of all activity descriptions and data you enter.
• You grant us a license to use your data to provide and improve the service.
• You are responsible for the accuracy of information you provide.

Prohibited content

You may not use the App to:

• Enter false or misleading information.
• Attempt to manipulate or game the system.
• Upload harmful, offensive, or illegal content.
• Violate any laws or regulations.

06Subscriptions and payments

Paid features

• Some features may require a paid subscription.
• Subscriptions are processed through the Apple App Store.
• Pricing is shown in the app before purchase.

Billing

• Subscriptions auto-renew unless canceled.
• You will be charged through your Apple account.
• Refunds are handled according to Apple's policies.

Cancellation

• You can cancel anytime through your Apple account settings.
• Cancellation takes effect at the end of the current billing period.
• No refunds for partial subscription periods.

Health disclaimer

IMPORTANT: Motion.ai is not a medical device and does not provide medical advice. Calorie calculations are estimates. Always consult a healthcare professional before starting any fitness program. Do not use the App to diagnose, treat, or prevent any medical condition.

Accuracy disclaimer

• We strive for accuracy but cannot guarantee 100% precision.
• Calorie burn estimates depend on the accuracy of data you provide.
• AI classifications are automated and may contain errors.
• You are responsible for verifying the accuracy of all data.

No warranties

THE APP IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED.

Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

• We are not liable for any indirect, incidental, or consequential damages.
• We are not liable for any health issues or injuries related to app use.
• Our total liability is limited to the amount you paid for the App (if any).

08Intellectual property

Our rights

• The App, including all content, features, and functionality, is owned by Arkn LLC.
• Our trademarks, logos, and brand features are protected.
• You may not copy, modify, or distribute the App without permission.

Your rights

• You retain ownership of your activity data.
• You can export or delete your data at any time.
• We do not claim ownership of your user-generated content.

09Data and privacy

We collect and use data as described in our Privacy Policy.

• You can access, modify, or delete your data through the App.
• We implement security measures to protect your information.
• We use third-party services (Mistral AI, Supabase, RevenueCat).

10Acceptable use

You agree NOT to:

• Reverse engineer, decompile, or disassemble the App.
• Use the App for any illegal purpose.
• Interfere with or disrupt the App's functionality.
• Attempt to gain unauthorized access to our systems.
• Use automated tools to access the App (bots, scrapers).
• Resell or redistribute the App or its content.
• Violate any applicable laws or regulations.

11Termination

By you

• You can delete your account at any time through the App.
• Deleting your account terminates your access to the service.
• Your data will be deleted within 30 days.

By us

We may suspend or terminate your account if you:

• Violate these Terms.
• Engage in fraudulent activity.
• Abuse the service or other users.
• Fail to pay subscription fees.

12Changes to terms

• Continued use after changes constitutes acceptance.

Severability

Assignment

Motion.ai is operated by Arkn LLC ("we," "our," "us"). Arkn LLC respects your privacy. This Privacy Policy explains how we collect, use, and protect your personal information when you use our mobile application.

01Information we collect

Information you provide

• Account information: email address, name, password.
• Profile information: age, weight, height, gender, activity level.
• Activity data: activities you log, duration, intensity, calories burned.
• Goals: weekly calorie-burn targets you set.

Voice & microphone data

• Voice input: when you use voice input, your microphone audio is transcribed on-device using Apple's Speech Recognition framework.
• Audio handling: only the resulting text transcript is sent to Mistral AI for activity classification; the audio itself is never transmitted or stored.
• No audio storage: we do not record, store, or share your voice audio.

Automatically collected information

• Usage data: how you interact with the app, features you use.
• Device information: device type, operating system version.
• Log data: crash reports, error logs.

02How we use your information

We use your information to:

• Provide and improve the Motion.ai service.
• Calculate personalized calorie-burn estimates.
• Track your progress toward fitness goals.
• Send you notifications about your activities.
• Respond to your support requests.
• Improve app features and user experience.

03Third-party services

Mistral AI (activity classification)

We use Mistral AI to help classify and process activity descriptions you enter. When you describe an activity, this text is sent to Mistral AI's servers for processing.

What we send to Mistral AI:

• Your activity descriptions (text only).
• No personal information, names, or identifying details.

What we don't send:

• Email address, name, or account information.
• Location data.
• Health metrics or historical data.

Mistral AI does not store your input after processing. Responses are used only to classify your activity.

Supabase (database & authentication)

We use Supabase to securely store your account and activity data. All data is encrypted at rest and in transit. This includes:

• Your account credentials (encrypted).
• Profile information.
• Activity logs and goals.
• App preferences.

RevenueCat (subscription management)

If you purchase a subscription, RevenueCat processes your payment information via Apple. No credit card information is handled by us directly.

04Data sharing

We do not sell your personal information to anyone. We only share data with:

• Mistral AI (activity descriptions for classification).
• Supabase (to store your data securely).
• RevenueCat (to manage subscriptions).
• Apple (for app distribution and payments).

05Your data rights

You have the right to:

• Access your data: export your activity logs.
• Delete your data: request account deletion.
• Correct your data: update profile information.
• Opt-out of AI processing: use manual activity entry instead.

06Data retention

• Active accounts: we retain your data as long as your account is active.

07Children's privacy

Motion.ai is not intended for users under 13 years old. We do not knowingly collect information from children under 13. If you believe we have collected information from a child under 13, please contact us immediately.
